It concerns hard core restrictions of competition like cartels as much as efficiency enhancing agreements. Article 101(1) TFEU which prohibits agreements, decisions by associations of undertakings and concerted practices that are restrictive of competition. Article 101(1) may be declared inapplicable where the criteria set out in Article 101(3) are satisfied.
